The Walt Disney Company is certainly no stranger to legal battles. The most significant in recent memory is the battle between Disney and Governor Ron DeSantis. Ultimately, Walt Disney World's special tax district was dissolved, and the lawsuits were dismissed.

Lawsuits are never pretty. And they also seem to be never-ending when it comes to multi-billion-dollar companies.

Now Disney is involved in a new lawsuit involving Disney's ABC. The other side of the lawsuit is the FCC (The Federal Communications Commission).

Disney's ABC is a broadcast company, which means its local stations use public airwaves. These stations need licenses in order to operate.

Normally, these types of licenses need to be renewed every eight years. However, the FCC has called for an investigation and early review of 8 ABC stations, even though their licenses still have 2-5 years left before their required renewals.  The FCC ascertains that the investigations are in response to possible violations of the Communications Act of 1934 and the FCC's rules, including the agency's prohibition on unlawful discrimination. 

Disney is now suing the FCC in an attempt to block the investigations. The lawsuit claims that the FCC's actions violate the First Amendment and threaten Free Speech.

The lawsuit alleges that the FCC is acting in retaliation for ABC's practice of continuing to air shows such as Jimmy Kimmel and The View, programs which are, at times, critical of the current administration. In other words, ABC is questioning whether the investigation is motivated by the influence and preferences of politicians rather than actual wrongdoing.

For context, President Trump himself has repeatedly urged broadcasters like ABC to drop comedy or news programs which have been critical of him or his administration. The president has also repeatedly called upon the FCC to strip ABC of licenses.

Now it is up to a judge to decide whether the lawsuit's claims are valid and the FCC's actions indeed violate the First Amendment, threatening Free Speech. Or is the investigation within the FCC's authority because it ensures communication laws are followed and is acting in the public's best interest?

It will be interesting to follow the court's decision on this one.

  1. My normal position is to rarely side with a regulator against a business. But I make an exception for ABC. ABC is nothing but a propaganda machine for left wing politics. Its news is biased, its talk shows are biased and its late night show, Jimmy Kimmel Live is just a nightly diatribe of non stop Trump hatred. Kimmel deserved to be taken off the air after lying about Charlie Kirk's murderer. He never should have been brought back. How Walt Disney's company could perpetuate this is beyond me, but looking at some of the damaging culture war garbage Disney threw at our children and grandchildren, it is consistent.
