A federal judge in Florida ruled today that the CDC overstepped its authority when it issued a mask mandate for planes and other forms of public transportation.

The decision Monday by U.S. District Judge Kathryn Kimball Mizelle in Tampa, an appointee of former President Donald Trump, also said the Centers for Disease Control and Prevention improperly failed to justify its decision and did not follow proper rule making.

The judge said “a limited remedy would be no remedy at all” and that the courts have full authority to make a decision such as this — even if the goals of the CDC in fighting the virus are laudable.

Our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the court declares unlawful and vacates the mask mandate.

The CDC recently extended the mask mandate to May 3. According to the CDC, this allowed more time to study the BA.2 omicron subvariant of the coronavirus.

The lawsuit was filed in July 2021 by two plaintiffs and the Health Freedom Defense Fund, described in the judge’s order as a nonprofit group that “opposes laws and regulations that force individuals to submit to the administration of medical products, procedures and devices against their will.”

The court’s ruling comes less than a week after the CDC extended the mandate for 15 days. Because of this ruling, the CDC mandate is no longer in effect and the TSA will not enforce it at this time, a Biden administration official said. Of course, Disney is still a private business so before you forgo the mask on Disney buses and the monorail. We are not 100% in the clear just yet. They are not currently required on the Skyliner or on boats.

TSA will no longer enforce the mask mandate on public transportation.
